Terms of Service

By accessing the website, creating an account, purchasing a license, downloading, activating, or using the tool, you agree to these Terms of Service. If you do not agree, do not use the service.

These terms apply between you and the individual operator in Denmark trading as XD Software. If you are using the tool on behalf of a business or other entity, you confirm that you have authority to bind that entity.

You must provide accurate account information and keep your login credentials secure. You are responsible for activity carried out through your account, except to the extent caused by our own failure to protect it.

We may require verification information reasonably necessary to deliver the service, enforce licensing, investigate abuse, or provide support.

Subject to these terms and your payment of the applicable price, we grant you a limited, revocable, non-exclusive, non-transferable license to use the tool for your own internal personal use.

The license is a one-PC lifetime license linked to your Discord account and Windows installation. Reinstalling Windows or moving to another PC may require a manual reset before the license can be used again.

Lifetime means a one-time license with no recurring subscription fee. New Apply and cleanup operations require an online account and entitlement check. Restoring your saved changes remains available while signed out or offline.

You may not, except where applicable law clearly prevents us from restricting it:

• share, resell, sublicense, rent, lease, or otherwise transfer the tool or your account;
• attempt to bypass license controls, hardware binding, security checks, or technical restrictions;
• reverse engineer, decompile, disassemble, or derive source code except to the limited extent non-waivable law permits it;
• use the service to commit abuse, fraud, unauthorized automation, or other harmful activity;
• interfere with the website, update systems, support systems, or related infrastructure; or
• misrepresent support issues, purchase history, or eligibility for a refund or reset.

We may update, modify, suspend, or discontinue features of the website or tool at any time, including to improve stability, security, compatibility, or abuse prevention.

We do not guarantee uninterrupted availability, permanent support for every platform or configuration, or that every update will be suitable for every system environment.

The tool is intended to help optimize Windows settings, reduce unnecessary system clutter, and support system-side tuning. Actual results vary by hardware, software, BIOS, game, driver stack, background services, and user configuration.

We do not guarantee any specific increase in FPS, reduction in latency, compatibility with every system, or compatibility with every game, launcher, anti-cheat, update, or third-party environment.

You remain responsible for understanding your own setup, backing up your system where appropriate, and making sure your use of the tool complies with the terms of any games, platforms, or third-party services you use.

Unless expressly stated otherwise at checkout, the tool is sold as a one-time purchase and not as a subscription.

Polar is the merchant of record for software purchases and handles checkout and payment receipts. Applicable statutory withdrawal, defect and refund rights remain available. Contact support@boostmyfps.com with your purchase reference to request help or a refund review.

For technical problems, support may request reasonable troubleshooting information. Any voluntary refund offered in addition to your legal rights is considered individually; troubleshooting does not remove rights that apply under mandatory consumer law.

Performance varies by system, and no particular FPS improvement is promised. This does not limit your rights if the software does not conform to the contract or applicable legal requirements.

Purchasing, downloading or using the software alone does not waive statutory withdrawal rights. Where immediate digital supply can lawfully end those rights, this requires your prior express consent, acknowledgment of the loss of the right and the required confirmation. These terms do not themselves record that consent.

We may suspend, restrict, or terminate access to the service or license if we reasonably believe there has been abuse, fraud, chargeback misuse, material breach of these terms, unlawful activity, or activity that threatens the integrity or security of the service.

Suspension or termination does not automatically entitle you to a refund.

To the maximum extent permitted by law, the website, tool, updates, and support are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunity arising out of or related to the service.

To the maximum extent permitted by law, our total aggregate liability for any claim relating to the service will not exceed the amount you paid for the license that gave rise to the claim.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

These terms are governed by Danish law, except where mandatory consumer protection law requires otherwise.

You agree that disputes relating to the service will be handled in the competent courts of that jurisdiction, subject to any non-waivable rights you may have under applicable consumer law.

We may update these terms from time to time. Updated terms will apply once posted, unless a later effective date is stated. Continued use of the service after updated terms become effective constitutes acceptance of the revised terms.
